DEFINITIONS

"Pregalates.com" refers to Pregalates.com, whose registered office is at 14 Raven Way, Noosaville, Queensland, Australia 4566.

"website" refers to any of the websites owned and operated by Pregalates.com.

"net order value" is the total value of the order after deduction of any discounts, deals or special offers but before the deduction of any vouchers issued by Pregalates.com. The net order value is used to calculate carriage and delivery charges.

GENERAL CONDITIONS

All orders for goods shall be subject to these terms and conditions. No variation of these terms and conditions shall apply unless agreed in writing by Pregalates.com.

Pregalates.com guarantee that all goods on offer are as described on the website and are fit for their intended purpose. Should any product fail to meet our high standards it will be replaced immediately. This does not affect your statutory rights.

Orders can only be accepted from customers who are 18 years or older. If you are under 18 years of age you are welcome to browse our website but regret that we are unable to accept any order from you.

We strongly recommend that you take the time to read and understand these Terms and Conditions fully as they will be binding upon you and will govern the contract between us once you have placed your order and it has been accepted by us. Upon acceptance we will send you an email confirmation of your order. However, we cannot guarantee receipt by you of such confirmation email and suggest that you contact us if you have not heard from us within 48 hours of placing your order.

If you choose to pay us by Credit your payment will be taken through the PayPal Pro UK Mechant system, your details and card payment transaction will be processed in a highly secure environment using 128 bit SSL Encryption.

PURCHASE & PAYMENT TERMS

A. Pricing

The price of the products will be those quoted on the website, errors & omissions excepted.

Delivery costs are as quoted and based on a fixed rate. These are payable by you and may be changed by us at our discretion.

Any special pricing offers made are intended to be independent and must not be used in conjunction with any other offer.

B. Purchases

We take payment at time of order and payment will be debited from your account prior to despatch of your purchase(s).

Payment for goods ordered can be made on-line by any major credit card, including American Express. In paying by this method you are confirming that the card being used is yours. In the event of payment being declined by your card issuer, Pregalates.com shall not be responsible for any costs or inconvenience caused by a subsequent delay in despatch.

A purchase order is not deemed accepted until we send you our order confirmation e-mail, whether or not this is received by you.

In the unlikely event of our not being able to satisfy your order due to stock unavailability, we will contact you with a view to agreeing an alternative solution.

Delivery

Delivery charges shown in the checkout page are dependent on your nominated delivery address.

Every effort is made to maintain stock levels to keep up with demand but to avoid disappointment it is advisable for you to allow as much time as possible when considering your purchase. We will communicate with you should any item not be in stock and indicate the best estimate for supply and delivery.

Please feel free to communicate with us at any time to ensure we are aware of your delivery requirements.

Products will be despatched to the delivery address you provide which we will treat as correct.

Once you receive the products, all risks of loss or damage shall pass to you and become your responsibility. Regardless of delivery and the passing of responsibility for loss or damage or any other provisions contained herein, the ownership of the products shall not pass to you unless we have received full payment for all products (including delivery charge) forming the total purchases made.

CANCELLATION, RETURNS & REFUNDS POLICY

Cancellation of Order

Under the Distance Selling Regulations, all UK customers have the right to cancel orders placed through a website within seven working days of their receipt of the goods. UK residents wishing to cancel an order under these Regulations should return the goods to the address below in their original packing and in their original condition and write to us letting us know that they intend to exercise this right.

Pregalates.com will not accept any responsibility for loss or damage to goods returned in this way until they are received at our below address, and we strongly recommend that returns are sent by Recorded Delivery or some other means of tracked delivery system that records both your proof of postage and a signed receipt of delivery. We cannot be responsible, nor can we refund/exchange, in cases of non-receipt by us.

Once we receive the goods in saleable condition, a refund for their cost will be made to the purchasing debit/credit card to the same named person.

Customers are responsible for the cost of returning the goods to Pregalates.com. Please note, we do not refund any carriage charges paid.

After seven days following your receipt of the goods, we will assume completion and acceptance of the items and your automatic right to refund will no longer be available.

If an item received is incorrect, faulty, or damaged we shall of course be happy to provide you with a full refund (including cost of delivery) or offer to replace the item at no cost to you. We will require you to return the original item, and will also therefore refund the return postage cost. Please utilise all the original packaging.
